On November 30, 2017, ERFA’s proposed rezoning plan was enacted into law by the NYC City Council. However, the developer of the 428-430-432 East 58th Street site (the site of the planned megatower that alerted us to the need for rezoning in the first place) applied for, and was granted, an exemption from the new law by the Board of Standards & Appeals (“BSA”). This gave the developer a green light to construct a megatower at the 58th Street site.
In August 2018, ERFA commenced a lawsuit in the NYS Supreme Court to reverse the BSA decision and thus require the developer to comply with the new zoning law.
